Terms of Service

1. The service

Appeard is an AI Visibility Monitoring service. We run a fixed set of search-style prompts each week against third-party AI engines (currently ChatGPT and Perplexity) and report how often your brand appears in their responses. We compute derived metrics (mention rate, margin of error, competitor gaps, citation sources) and offer rule-based improvement suggestions.

Appeard is a measurement tool. We do not guarantee any particular AI Mention Rate, ranking, or business outcome.

2. Your account

• You must be at least 18 years old to use Appeard.
• You are responsible for keeping your password confidential and for all activity under your account.
• You agree not to share account credentials with users outside your organisation. Add seats via the team management page if you need additional users.

3. Acceptable use

You agree not to:

• Configure brand names or keywords that you do not have permission to monitor on behalf of the relevant business.
• Use the service to scrape, replicate, or compete with the AI engines we query.
• Reverse-engineer, sublicense, or resell the service without a written agreement.
• Submit content that is unlawful, misleading, defamatory, or infringes third-party rights.

We reserve the right to suspend accounts that violate these rules.

4. Subscription, billing, and cancellation

• Paid plans are billed monthly or annually in advance via Razorpay.
• Subscriptions auto-renew at the end of each billing cycle until cancelled.
• You can cancel at any time from the Settings page. Cancellation takes effect at the end of the current billing period.
• Refunds are governed by our Refund Policy.

5. Service availability

We aim for 99% monthly uptime but do not commit to a formal SLA on standard plans. Weekly scans depend on the availability of upstream AI engines (OpenAI, Perplexity) and may be delayed or skipped if those engines are unavailable.

6. Data ownership

You retain all rights to the brand information you submit. We retain rights to our software, our scoring methodology, and our aggregated benchmark statistics (which never include identifying information about any individual customer).

7. Disclaimers

The service is provided “as is” without warranties of any kind. AI engines change behaviour frequently; the prompts and responses you see may differ from a third party's observation of the same engine at the same time. The margin of error reported alongside each metric is an explicit acknowledgement of this variance.

8. Limitation of liability

To the maximum extent permitted by law, Appeard's total liability for any claim arising out of or relating to the service is limited to the amount you have paid us in the 12 months preceding the claim.

9. Changes to these terms

We may update these terms from time to time. Material changes will be announced by email at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the new terms.

10. Governing law

These terms are governed by the laws of the jurisdiction in which Appeard is incorporated, without regard to conflict-of-law principles.
